OSHA’s Extreme Heat Worker Safety Proposal
President Briden’s new suggested rule, in conjunction with OSHA’s (Department of Labor’s Occupational Safety and Health Administration) proposal, is the first of its kind. If OSHA’s proposal passes, employers will be required to provide new safeguards for workers to protect against extreme heat and mitigate heat illness and injuries. OSHA’s proposal takes into account two heat indexes, measuring both temperature and humidity.
If passed, this proposal will mandate employer training to correctly identify heat risks and will require employers to provide rest breaks, shade, water, and heat acclimatization areas for workers. This proposal will affect millions of employees in a variety of industries including farmworkers, construction workers, delivery workers, landscapers and outdoor workers, warehouse and factory employees, and kitchen workers.
Heat related workplace injuries and fatalities have continued to rise year after year with more states steadily implementing heat and temperature safety measures for workers. Since 2021, OSHA has been focused on heat related working condition standards to better understand heat impact and employee risk.
